Terms of service

This is a draft. It has not been accepted by anyone, no one has been charged, and live card checkout is closed on every deployment of Underwrite. It is published so you can read what would govern a subscription, including the parts that are still blank.

There is no accounts system, so there is no record anywhere of a person having accepted a version of these terms. Recording the accepted version at checkout is work that has not been done. Until it is, a subscription would have no acceptance record, which is one more reason checkout stays closed.

Today the only contact anywhere in the product is ali@getunderwrite.com, which reaches the founder directly. It is named here as the working address, not as a confirmed support channel, because the founder has not confirmed one.

Underwrite is a commercial real estate underwriting desk. You enter or import a deal, deterministic TypeScript computes returns, debt coverage, sensitivities and a verdict, and you decide. The financial math runs in code with a published method and a regression suite, not in a language model: same inputs, same outputs, no sampling. The method is at /methodology and the engine source is rendered from the live files at /methodology/engine.

AI is used for extraction and for qualitative review, each only when you press something. The engine is never one of them: no model computes an IRR, a multiple, a verdict or a grade, and no figure a model returns is used as an output. Extraction does change inputs, because that is what extraction is for, and the engine then recomputes from them as it does from anything you type. What the AI boundary is, feature by feature, is at /trust.

Nothing in the software is behind a subscription. There are no accounts, so no code path anywhere checks whether a person has paid before running a feature. The desk, the parser, the memo, the workbook, saved deals and share links work the same for someone who has never paid.

Underwrite is software that computes a model from the assumptions you give it. It is not investment advice, not a recommendation to buy, sell or finance anything, not an appraisal, and not a substitute for your own diligence, your own counsel or your own lender. The verdict it prints is the output of two published rules applied to your inputs. If the inputs are wrong, the verdict is wrong.

The model has boundaries it does not cross, listed at /methodology/beyond-phase-1 and registered on the desk itself. Read them before relying on an output.

No certification stands behind any of this. There is no SOC 2 report, no ISO 27001 certification, no third-party penetration test, and no signed data processing agreement with any provider. /trust says the same.

No offer is written in this document and no price promise is made in it. The founder has not decided whether a monthly subscription buys defined founder support or paid software access, and those are different products with different obligations, different refund consequences and different consumer-law treatment. This document does not choose between them.

/pricing states the price and renewal terms the founder intends, and says beside them that what they would buy has not been decided. While these terms are staged and live checkout is closed, that is a statement of an intention, not a contract and not an available purchase.

Send only material you have the right to send. When you upload or paste a document, it travels through Underwrite's server to Anthropic's API for extraction and comes back as structured values; if a document is confidential in a way that forbids that, use Confidential Mode, which turns off the parser, the AI review, the memo's AI summary, share links and memo links, or enter the numbers by hand.

The AI features (the parser, the AI review and the AI summary) are rate limited per connection, and that is the usage limit the code enforces on them. Everything deterministic is unlimited. Do not attempt to circumvent the limit, resell access, or present Underwrite's output as an appraisal or as advice from anyone other than yourself.

Tax treatment is PENDINGTax treatment. Is the subscription price tax inclusive or tax exclusive, and who remits any sales tax or VAT?

Until that is settled, no price can honestly be shown as tax inclusive or tax exclusive at checkout, which is itself a reason checkout is closed.

The customer jurisdictions this product may sell into are PENDINGCustomer jurisdictions. Which countries or states may subscribers be in, and are any of them excluded?

Governing law, venue and dispute resolution are not stated in this draft. They depend on where the seller operates and where its customers are, neither of which is settled, and they need a lawyer to draft. The same is true of a limitation of liability, a warranty disclaimer with legal effect, and an indemnity. None of those clauses is in this document.

Each version of this document carries a version marker, shown at the top of the page and in the page source. Version 0.1-staged is the staged draft. When an offer is approved and these terms go into force, the version a customer accepted has to be recorded at the moment of checkout; that record does not exist yet, and building it is part of what has to happen before anyone is charged.
